OK folks! The new "Live Art" section of VORCAN.com is now online! There are only three movies there right now, but more to follow! Take a minute to browse VORCAN.com and let me know what you think! We have been working to work out all the bugs and some pages have yet to be made, but I think it is coming together rather nicely. OH, and if you are in Philly on Sunday night, come down to The Khyber for another VORCAN Painting Live Music Series with Come Dionysus. I'll post more about them when I have more time... Painting Live Music Video Update!!!Due to the release of Jay-Z's new album, VORCAN.com decided to release F!Jay-Z tribute on You Tube! What is F!Jay-Z you ask? A few weeks ago VORCAN wasat UPENN painting to the live music of the band F!. Definitely check out this band if you already haven't. They play "music for the villian", soundtrack, Danny Elfmanesque stuff. Check them out at www.myspace.com/fmusic The show happened to be cut short, and the painting was not done...it just so happened to be a 40"x40" canvas, and Jay-Z just so happened to be having a VIP 40/40 Club 1 year anniversary in Atlantic City the next night. We took the painting home and continued to work on it listening to more F! on cd, video taping the entire process.... The next morning we edited both Jay-Z and F! music together for the soundtrack, burned it on DVD, wrapped up "Pat Panang Popped Up In Brooklyn" and drove to A.C. to deliver President Carter's anniversary gift. We still have yet to hear word on whether Jay-Z enjoyed the gift or not, but in honor of his new release, we figured we would release the video....so here it is: F! We have a great show tonight at The Fire in Northern Liberties! FUTURE ROCK!www.futurerock.net/Organic instruments + electronic synthesis + clever song writing. Three musicians exist in a web of sound constructed electronically with the use of live samples. The audience dances at the show and hums the melody at home. Future Rock. Chicago sound guru and promoter, Leif Moravy assembled the trio in early 2004. "I saw the niche and I attacked it. Everything in Chicago is moving in this direction," Leif explains. Mickey Kellerman and Felix Moreno utilize a myriad of synthesizers, electronics, and instruments to compose and arrange their instrumental music. The audience can rarely identify the origin of each sound. "I love that look of confusion... when the audience sees me play my bass and they have no idea what's coming out," says Moreno. Drummer Darren Heitz finishes FR's sound by blending acoustic and electronic drum timbres with live sampling through his synthesizers. Kellerman explains, "We manage to pull off our live show while keeping pre-recorded samples to a minimum. Ninety-nine percent of our live show is live." This concept is at the core of Future Rock: technology has progressed so that real-time sampling and electronic synthesis can now occur on-stage. "Its really important to not get to geeky with our music. People want to hear songs with melodies or grooves they can dance to. Its a question of utilizing the new technology with the old song structure so that kids can rock out the same way, but to new sounds," Heitz adds. Doesn't matter....there are tons of names that are exactly the same for many different things. That is NOT copyright infringement. Your post alone proves the example...you sighted three separate definitions of Vorcan that are not infringing on any other.
Now, if there was another art production company and abstract consulting firm by the name of "Vorcan", that would be a different story.
You cannot infringe on copyright laws if your product's name is not similar to another product with the same name.
Here is an excerpt from a lawyer I was in contact about copyright laws....
"The core of protection of intellectual property is use. So if (VORCAN) are out in the market place using their symbol or trade dress then they are taking the correct steps to protect their right to that symbol. However there are statues, federal and state which provide a more formal process of protection. Even if an applicant prepares and properly files at the federal and/or state level it is the use that establishes the right, meaning that all the paper work in the world won't protect if an adversary in court makes a good claim that they were there first and using in the same market place or that the other side abandoned its rights through lack of use. Also you may recall that there is a legal search engine "Lexus/Nexus" and an Japanese import car "Lexus". There was litigation in which a court found that the businesses were in different market places and there was no reasonable chance that that consumers would be misled. You'll notice the "Burlington Coat Factory" disclaimer used in its advertising that it is not affiliated with Burlington Industries. So all of this is very fact specific. I think that the best thing to is be out in their relevant market place, using business name, the logo and the slogan and establishing their rights to the intellectual property through use."

The only reason I have ever found not to talk, is to ultimately listen. If you sit in a room full of people and no one talks, I would hope it is because you are all listening to something very important, like silence. And I have found that the reason people murmur or speak up in a room of silence is not because they are dominant, but rather they have stopped listening.

I personally enjoyed a station with the three artists in mind being Rashaan Roland Kirk, Tortoise, and The Brazilian Girls...the unusual music I never heard of was plentiful!
Pandora is awesome.
